These Terms of Service govern your use of this website and any purchase you make from Lumira ("we", "us", "our"). By browsing this site or placing an order, you agree to them. Please read them alongside our Shipping Policy, Refund Policy, and Privacy Policy, which form part of these terms.

1. Who can order

You must be at least 18 years old, or the age of majority where you live, to place an order. You must provide a shipping address within the United States, and the payment details you use must be your own or used with the account holder's permission.

2. What we sell — please read this part

We sell fashion jewellery. We want you to know exactly what you are buying, so to be plain about it:

The metals are plated, not solid. Our pieces use a base metal — titanium steel or copper alloy, depending on the item — with a gold, rose gold, or silver-tone plated finish. Nothing we sell is solid gold, solid silver, or sterling silver, and it is not sold or priced as such.
The stones are not precious. They are cubic zirconia or crystal, chosen to catch the light. They are not diamonds, and they are not natural gemstones. Birthstone pieces are colour-matched to the traditional colour of each birth month; the stone is crystal, not the mineral itself.
The rose in our gift box is a soap flower. It is not a fresh flower and not a preserved flower. It will not wilt, and it does not need water.
The exact material of each item is listed on its product page. If a material matters to you, check there or ask us before ordering.

Photographs are as accurate as we can make them, but colours vary between screens, and small variations between individual pieces are normal. Measurements are approximate.

3. Wearing and caring for your jewellery

Plated finishes wear over time. To keep yours looking right, take it off before showering, swimming, or exercising, and put it on after perfume, lotion, and hairspray rather than before. Store it dry.

We cannot guarantee that any item is hypoallergenic or free from nickel. If you have a known metal sensitivity, please contact us before ordering and we will tell you what we know about the materials.

4. Prices and availability

All prices are in US dollars and may change without notice. Any applicable sales tax is calculated and shown at checkout.

We try hard to keep prices and stock accurate, but errors happen. If an item is listed at an obviously incorrect price, or is unavailable after you order, we will contact you and either cancel the order and refund you in full or offer you the chance to continue at the correct price. We are not obliged to sell at an incorrect price.

5. Orders

Your order is an offer to buy. Our order confirmation email acknowledges that we have received it; a contract is formed when we dispatch your order. We may refuse or cancel an order — for example where we suspect fraud, where an item is unavailable, or where a pricing error has occurred. If we cancel after you have paid, we refund you in full.

6. Discounts and promotions

LUMIRA15 gives 15% off and may be used once per customer.
Our buy any two, save 15% offer applies automatically at checkout when your basket contains two or more items.
These two offers cannot be combined. Where more than one applies, checkout will apply one of them.
Promotions have no cash value, cannot be applied to an order after it has been placed, and may be changed or withdrawn at any time.

7. Payment

Payment is taken at checkout through Shopify and its payment providers. We do not receive or store your full card details. You confirm that you are authorised to use the payment method you provide.

8. Shipping and returns

Shipping times, costs, and coverage are set out in our Shipping Policy. Refunds, replacements, damaged items, and cancellations are covered by our Refund Policy. Please note that we do not accept change-of-mind returns — that policy explains what we do and do not cover.

9. Our content

The Lumira name, logo, product photography, page designs, and written content on this site belong to us or are used with permission, and are protected by copyright and trade mark law. You may browse, share links, and print pages for your own personal use. You may not copy our content for commercial purposes, resell our product listings, or use our branding without written permission.

10. Acceptable use

Please do not use this site to break the law, to place fraudulent orders, to interfere with the site's operation or security, to scrape or harvest data from it, or to upload anything harmful. We may suspend access where we reasonably believe any of this is happening.

11. Links to other sites

Where we link to a third-party website, we do so for convenience. We do not control those sites and are not responsible for their content, products, or privacy practices.

12. Disclaimers

We provide this website on an "as is" and "as available" basis. We do not warrant that it will be uninterrupted, error-free, or secure at all times. To the fullest extent permitted by law, we exclude implied warranties in relation to the website itself. This does not affect any warranty or guarantee that applies to the goods you buy, or your statutory rights.

13. Limitation of liability

To the fullest extent permitted by law, our total liability to you in connection with any order is limited to the amount you paid for that order. We are not liable for indirect or consequential losses — for example lost profits, or a gift not arriving in time for a particular occasion.

Nothing in these terms excludes or limits our liability for death or personal injury caused by our negligence, for fraud, or for anything else that cannot lawfully be excluded. Some jurisdictions do not allow certain limitations, so parts of this section may not apply to you.

14. Indemnity

You agree to indemnify us against claims, losses, and reasonable costs arising from your breach of these terms or your misuse of this website.

15. Governing law

These terms are governed by the laws of the State of North Dakota and the United States, without regard to conflict-of-law rules. Disputes will be handled in the courts of North Dakota, unless the consumer protection law where you live gives you the right to bring a claim elsewhere.

16. Changes to these terms

We may update these terms from time to time. The version published on this page at the moment you place an order is the version that applies to that order. The "last updated" date above tells you when they last changed.

17. General

If any part of these terms is found to be unenforceable, the rest continues to apply. A delay in enforcing any part of these terms is not a waiver of it.
